In this document, the action agencies are NMFS Office of Protected Resources, Permits and Conservation Division (hereafter referred to as “the Permits Division”) and U.S. Army Corps of Engineers (USACE). The Permits Division plans to issue an incidental harassment authorization (IHA) pursuant to section 101(a)(5)(D) of the Marine Mammal Protection Act of 1972, as amended (MMPA; 16 U.S.C. § 1361 et seq.), to the Port of Alaska (POA) for harassment of marine mammals incidental to the proposed action of constructing a floating dock. The USACE plans to issue a permit for the proposed action (POA-2003-00502). The consulting agency for this proposal is NMFS’s Alaska Region. This document represents NMFS’s biological opinion (opinion) on the effects of this proposal on endangered and threatened species and designated critical habitat. This opinion replaces a 2019 letter of concurrence for the SFD provided to the USACE (NMFS # AKRO-2019-01783).
