Biological Opinion - Port of Alaska’s Petroleum and Cement Terminal, Anchorage, Alaska

Endangered Species Act Section 7(a)(2) Biological Opinion on plans to issue two incidental harassment authorizations for the first phase of the Port of Alaska Modernization Program. NMFS Consultation Number: AKRO-2018-01332.

In this document, the action agencies are NOAA Fisheries Office of Protected Resources, Permits and Conservation Division (hereafter referred to as “the Permits Division”) and U.S. Army Corps of Engineers (USACE). The Permits Division plans to issue two incidental harassment authorizations pursuant to section 101(a)(5)(D) of the Marine Mammal Protection Act of 1972, as amended (MMPA; 16 U.S.C. § 1361 et seq.), to the Port of Alaska for harassment of marine mammals incidental to the proposed action. The USACE plans to issue a permit for the proposed action (POA-2003-00502). The consulting agency for this proposal is NOAA Fisheries Alaska Region. This document represents NOAA Fisheries’ biological opinion on the effects of this proposal on endangered and threatened species and designated critical habitat.
