Summary: NOAA Fisheries has received a request from the United States Navy for authorization to take marine mammals incidental to 2 years of construction activities associated with the Naval Facilities Engineering Command Northwest Maintenance and Pile Replacement project in Puget Sound, Washington. NOAA Fisheries is requesting comments on its proposal to issue two consecutive 1-year incidental harassment authorizations to incidentally take marine mammals during the specified activities. NOAA Fisheries is also requesting comments on a possible one-time, 1-year renewal that could be issued under certain circumstances and if all requirements are met, as described in Request for Public Comments at the end of this notice. NOAA Fisheries will consider public comments prior to making any final decision on the issuance of the requested MMPA authorizations and agency responses will be summarized in the final notice of our decision.

Chevron’s activities will not be completed prior to the IHA’s expiration. NOAA Fisheries requested comments on both the proposed IHA and the potential for renewing the initial authorization if certain requirements were satisfied. The renewal requirements have been satisfied, and NOAA Fisheries is now providing an additional 15-day comment period to allow for any additional comments on the proposed renewal not previously provided during the initial 30-day comment period.

Summary: On February 5, 2024, NOAA Fisheries received a request from the Municipality of Skagway to modify an incidental harassment authorization that was issued to MOS on August 29, 2023 to take small numbers of 8 species of marine mammals, by Level A and Level B harassment, incidental to the Skagway Ore Terminal redevelopment project. NOAA Fisheries is requesting comments on its proposal to modify the IHA. This modification includes changes to the amount of authorized take by Level B harassment for Steller sea lions and the addition of take by Level A and Level B harassment for the northern fur seal (Callorhinus ursinus). There are no changes to the activity, mitigation and monitoring, NOAA Fisheries' findings, the effective dates of the issued IHA, or any other aspect of the IHA. NOAA Fisheries will consider public comments prior to making any final decision on the requested modification of the authorization and agency responses will be summarized in the final notice of our decision.

Summary: NOAA Fisheries is proposing to modify the incidental harassment authorizations (IHAs) that were issued to the United States Navy on September 25, 2020 for the Transit Protection Program construction, due to an elevated harbor seal take rate at the nearby Naval Base Kitsap Bangor Service Pier Project that was unanticipated during the initial analysis for these TPP IHAs. NOAA Fisheries is proposing to modify the TPP project IHAs to increase authorized take by Level A harassment of harbor seal in the Year 1 IHA, and add Level A harassment take of harbor seal to the Year 2 IHA. NOAA Fisheries is also proposing to revise the shutdown mitigation provisions for harbor seals in the modified IHAs, and adjust the effective dates of both IHAs to accommodate the Navy’s plans to delay the project. The monitoring and reporting measures remain the same as prescribed in the initial IHAs, and no additional take was requested for other species.

The scope of the activities and anticipated effects remain the same, authorized take numbers are not changed, and the required mitigation, monitoring, and reporting remains the same as included in the initial IHA. NOAA Fisheries is, therefore, issuing an identical IHA to cover the incidental take analyzed and authorized in the initial IHA.

The City of Ketchikan has requested a subsequent reissuance of the IHA with new effective dates of October 1, 2023, through September 30, 2024. The scope of the activities and anticipated effects remain the same, authorized take numbers are not changed, and the required mitigation, monitoring, and reporting remains the same as included in the initial IHA.
